Employment discrimination refers to employment decisions or treatment of an employee based on certain protected characteristics or attributes. Such discrimination occurs when an employer takes any action concerning an employee or job applicant because of that employee’s membership in a protected group rather than based on that individual’s actual qualifications or job performance.
Workplace discrimination is an employment action taken by an employer based upon an individual’s race, color, religion, national origin, gender, or age. The discrimination laws are constantly evolving, with sexual orientation and sexual identity being two classes recently recognized as protected classes. Individual states may also add additional protected classes, such as height, weight, or family status.
